2. Scope and contract language

These terms apply to all orders placed on poshalleycats.com. Different terms of the customer apply only if we expressly agree to them in writing. The contract languages are German and English.

3. Ordering and conclusion of the contract

The products shown in the shop are not a binding offer. How to order: choose a product and size, add it to the cart, go to checkout, enter your contact and delivery details, choose shipping and payment. Before you submit, you see a summary and can correct all entries with the back function or in the cart. By clicking “Pay now” you make a binding offer. The contract is concluded when we confirm your order by email; we send this confirmation right after your order. We store the contract text. You receive the order details with the order confirmation; you can view and save these terms on this page at any time.

4. Prices and shipping costs

All prices are in euros and include statutory VAT. Shipping costs and delivery times are listed in our shipping policy and are shown before you submit your order. For deliveries outside the EU, customs duties, import taxes and carrier fees may apply (for example in the USA). They are paid by the recipient.

5. Payment

The payment methods shown at checkout apply. Payment is due when the contract is concluded.

6. Delivery

We deliver to the countries offered at checkout. Officially licensed designs (SpongeBob, Teenage Mutant Ninja Turtles, Garfield) ship to the EU, Switzerland and the UK only, as our licensing agreements require. If an item is unexpectedly not available, we inform you immediately and refund any payment without delay.

7. Retention of title

The goods remain our property until paid in full.

8. Right of withdrawal for consumers

Withdrawal information

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, take physical possession of the goods. If several goods of one order are delivered separately, the period starts when you receive the last item.

To exercise the right of withdrawal, you must inform us (Solution Society Consulting GmbH, Moosstraße 98b, 5020 Salzburg, Austria, email: meow@poshalleycats.com) of your decision by a clear statement. The easiest way is our withdrawal function “Withdraw from contract”. You may also use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient that you send your communication before the withdrawal period has expired.

Effects of withdrawal: If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except for supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your withdrawal. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before the period of 14 days has expired. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

9. Exchanges

In addition to the statutory right of withdrawal, we are happy to exchange size or design within 14 days of delivery if the item is unworn with tags attached. Email us at meow@poshalleycats.com. Your statutory right of withdrawal is not affected.

10. Warranty

The statutory warranty applies. The warranty period is two years from delivery. Please report defects to meow@poshalleycats.com.

11. Liability

We are liable without limitation for intent and gross negligence and for personal injury. We are not liable for slight negligence, except for personal injury. Claims under the Product Liability Act remain unaffected.

12. Gift cards

Gift cards do not expire and can be redeemed for all products in the shop. They cannot be exchanged for cash.

13. Intellectual property

14. Governing law and jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the country where you as a consumer have your habitual residence remain unaffected. For businesses, the place of jurisdiction is Salzburg.

15. Dispute resolution
